The procedure for filing a notification of residence under the RVP

According to the requirements of the migration legislation of the Russian Federation, every foreigner (whether a citizen of another state or a stateless person) living in Russia on the basis of a temporary residence permit (TRP) is obliged to annually confirm his stay on Russian territory. Failure to comply with this requirement without objective reasons is fraught with a number of negative consequences for the migrant.

Residence notice for RVP

Residence notice is a mandatory procedure, during which the owner of the RVP informs the authorized state bodies of the Russian Federation within the prescribed period that he, during the reporting period:

  • Lived and carried out other legal activities within the region of the Russian Federation where the permit was issued;
  • Received a legal income in an amount sufficient to meet both his own and the needs of his dependents (subject to their availability);
  • Has not left the Russian Federation for a period exceeding 6 consecutive months.

The necessity of the procedure under consideration is enshrined at the legislative level (part 9 of article 6 of Federal Law No. 115-FZ) and applies to all categories of RVP holders without exception.

Notices of the residence of minors and / or incapacitated foreigners are submitted by their legal representatives (parents, trustees, guardians, etc.).

Confirmation procedure

The considered procedure consists of:

  1. Drawing up an appropriate notification;
  2. Preparation of other documents;
  3. Submission of notifications and documents to the migration department of the Ministry of Internal Affairs of the Russian Federation at the place of issuance of the RVP;
  4. Receiving the detachable part of the submitted notification in your hands.

In cases where a foreigner has changed his place of residence (within the established region, or changed the region on a legal basis), the notification can be submitted to the authorized department of the Ministry of Internal Affairs at the new place of residence.

The legally established confirmation period is no later than 2 months after the expiration of the next 12 months during the period of validity of the permit.

As of 2021, the list of documents required to confirm residence includes:

  • Relevant notification;
  • Identity card (foreign passport, or another document similar from a legal point of view, as well as its notarized translation);
  • Directly RVP (stamp in the passport, or an independent document - depending on the international status of the foreigner);
  • Documentary proof of legal income.

As confirmation of the financial position, any of the following documents can be submitted (depending on the activity carried out by the foreigner):

  1. Tax return - for persons engaged in entrepreneurial activity;
  2. Help in the form 2-NDFL - for officially employed persons;
  3. Bank statement - for persons with other legal sources of income.

These documents are absolutely equivalent from a legal point of view. The main condition for accepting any of them is the compliance of the amount of income with the value of the subsistence minimum established for the region.

Filling out the notice

The direct notification on the RVP is drawn up on a two-sided form of a legally approved sample. A physical copy of the form can be obtained from the migration department of the Ministry of Internal Affairs, while an electronic form of the document can be downloaded from the official website of the Ministry of Internal Affairs.

The main part of the notification indicates (all information except for the addressee refers to the owner of the RVP):

  • Addressee (head of the authorized department of the Ministry of Internal Affairs at the place of issuance of the TRP and / or residence of the foreigner);
  • Full name, date of birth, information on valid citizenship;
  • Residence address (including postal code) and contact phone number;
  • Information about labor activity for the past year (dates of hiring and dismissal, a list of places of work with their addresses, as well as the names of employing organizations);
  • Information about trips outside the Russian Federation during the past year (indicating specific countries and periods of stay in them);
  • Information about the sources and amount of income received over the past year;
  • List of applications.

General requirements for registration:

  1. The document is filled out in Russian (by hand or in electronic form);
  2. All information is entered on the basis of documents confirming it;
  3. Corrections and / or factual errors are unacceptable.

The timing

The period of validity of the RVP is 3 years. That. the number of required confirmations - 2 (for the first and second years, lived on the basis of a permit). At the end of the third year, confirmation is not required as the permit will automatically terminate and cannot be renewed. By this time, the holder of the RVP must obtain a residence permit, or leave the Russian Federation.

Responsibility for violation of the notification procedure

For violation of the terms of confirmation of residence, the legislation of the Russian Federation provides for administrative liability (Article 18.8 of the Administrative Code of the Russian Federation), namely:

  • Imposition of a monetary fine in the amount from 5 to 7 thousand rubles (for a violation committed within Moscow, St. Petersburg or adjacent regions) and from 2 to 5 thousand rubles. (for other regions of the Russian Federation);
  • Administrative expulsion from the Russian Federation (in the context under consideration, this measure is applied only in cases of repeated violation of the procedure for filing a notification within 1 year and / or if the migrant commits other administratively punishable acts).

Liability can be avoided only by presenting evidence of the impossibility of observing the obligation in question for objective reasons (for example, due to prolonged hospitalization).

Annual notification of the state bodies of the Russian Federation about residence under the temporary residence permit is the duty of each holder of this permit. Failure to comply, as well as ignoring this obligation, is fraught with administrative measures for a foreigner - from a minor fine to expulsion from the Russian Federation.
