Uzbekistan is one of the actively developing post-Soviet republics. But, despite the prospects, mild climatic conditions and low unemployment, many residents tend to leave the country in search of great benefits and opportunities. One of the conditions for legalization abroad, including the Russian Federation, is the renunciation of the citizenship of Uzbekistan. Those planning a move should prepare for a rather bureaucratic process.

What is dual citizenship

Acquisition of citizenship in most countries involves leaving the previous citizenship. For this, it is necessary to have a certain basis, the applicant's desire alone will not be enough to satisfy the application.

Dual citizenship in Uzbekistan is not legally stipulated. Only residents of countries with which bilateral agreements have been signed can become holders of this status. For example, in the Russian Federation today, the mutual recognition of dual citizenship is secured only with Tajikistan.

This means that in all other cases we are talking about a second citizenship. Its acquisition becomes possible due to the fact that it is not necessary to wait for a presidential decree on renouncing the citizenship of Uzbekistan. With the application for new citizenship, a copy of the application for renunciation of the previous one is submitted (among other documents), which the candidate sends to the authorized authority.

To whom and for what it is necessary to leave the Uzbek citizenship

The main direction of migration for citizens of the Republic of Uzbekistan is the Russian Federation. Some seek to obtain a passport of this country, others only plan to realize themselves in the professional sphere, although it is possible to work in the Russian Federation without citizenship, on the basis of a work permit. And yet, the completed legalization process provides many benefits, ranging from social benefits to free education for children.

In addition to the fact that a migrant can voluntarily decide to give up his Uzbek indigenous people, he can be forcibly deprived of the right to be called a citizen of his native country. In legal circles, this procedure is called “loss of citizenship of the Republic of Uzbekistan”.

Most often this is due to the admission to service in the state bodies of another country:

  • to the police and security services;
  • to the courts;
  • to the executive authorities.

Those who are found guilty of illegal actions can also be forcibly deprived of citizenship: obtaining a resident status on fictitious documents, violating the requirement to register with a consular officer during a long stay abroad.

There is no direct prohibition on the possession of two passports in either Russian or Uzbek laws. But each country will continue to consider the bipatrid exclusively as its citizen, with all the rights and obligations that follow from this.

The choice of instance for filing a petition will depend on where exactly the applicant lives: in Uzbekistan or already abroad.

Applying in Uzbekistan

Those who applied to the regional offices of the Ministry of Internal Affairs at the address of registration can withdraw from the citizenship of the Republic of Uzbekistan on its territory. Citizenship issues are dealt with by the so-called OVViOG - Departments of Entry-Exit and Citizenship Registration.

The applicant must prepare a complete package of documents. There is no single list in the country. Each region compiles its own list, so you need to clarify it in advance. All copies and references must be made in duplicate. Samples of filling out all the papers can be found at the department of the Ministry of Internal Affairs, where the application will be submitted.

Please note that the renunciation of Uzbek citizenship in Tashkent can be no less troublesome than if the procedure is carried out already in the country of the new citizenship. Although the resolution of the issue of renouncing citizenship through consulates is often delayed up to 3-5 years.

Applying abroad

You can renounce Uzbek citizenship in Russia at the diplomatic mission of the republic.

You can submit your petition to any of the following departments:

To contact the consulate, you will need to present a departure sheet (certificate of discharge from the previous place of residence) and register with the consular register.

Persons registered in Uzbekistan must apply on the issue of withdrawing from the status of a citizen in their homeland. Renunciation of Uzbek citizenship without a departure sheet in Russia is impossible.

Sending an application by mail

The application procedure takes place in the personal presence of the applicant, regardless of where exactly he decides to apply. In rare cases, it is allowed to contact the department remotely. This usually happens when the applicant's health does not allow him to come to the institution on his own or if the office is located too far away.

If we turn to foreign experience, then in Germany, for example, documents can be sent by mail only for preliminary verification by the department. You should bring the main package yourself. Uzbek and Russian laws are even harsher.

It is not possible to send a renunciation of Uzbek citizenship by mail or e-mail. Alternatively, you can issue a power of attorney for a third person and notarize it. But this will not relieve the applicant from the need to document the reasons for his absence. For example, a certificate from a polyclinic about a deteriorating health will be able to act as evidence.

How is the withdrawal from citizenship

Officially, the applicant will be deprived of citizenship after the corresponding presidential decree is signed. But before that happens, the documents will go through several rounds of verification. Important: after an Uzbek citizen has become a resident of another country, he has exactly one month to notify the authorized bodies in his homeland about this.

The procedure for renouncing the citizenship of Uzbekistan begins with the fact that the consulate submits a package of papers for consideration to the Ministry of Foreign Affairs of the republic. The department, in turn, sends a request to the Security Service and the Ministry of Internal Affairs of the state, after which it draws up an opinion and sends the case to the Commission on Citizenship Issues.

Having considered the request, the members of the commission make a decision on the approval or refusal of the application. Only after that, the loss of Uzbek citizenship is confirmed by the signature of the President of the Republic. The signed decree is published on the website of the Embassy, ​​and the applicant is issued a certificate confirming the fact of withdrawal from citizenship.

Package of documents

The reason for the delays in the consideration of the application may be the lack of any certificates or errors in the application.

The list of documents for renouncing the citizenship of Uzbekistan may differ depending on where the application is submitted - at home or abroad. The applicant will have to collect two folders, which must contain the originals of the papers and their notarized copies. You need to fold documents in the order that will be indicated in the inventory.

The standard kit looks like this:

  1. Application for renunciation of citizenship of the Republic. It is this that is the basis for the procedure. Has an established form and is drawn up in the name of the President. A sample application for renouncing Uzbek citizenship can be found on the website of the Embassy.
  2. Application form. Contains personal information about the applicant and his relatives who live on the territory of the Republic and abroad.
  3. Autobiography. Has no fixed form. It is assumed that in it the applicant must provide information about the places of study, work, family composition.
  4. 4 photos measuring 45 by 35 cm.
  5. Civil passport, copies of its pages.
  6. Marriage certificate (if any).
  7. Consent of the second spouse to renounce citizenship. Served only if both husband and wife are Uzbeks.
  8. Certificate confirming the absence of debts. Such a document is to be obtained from the housing office and from the tax authority.
  9. Receipt for payment of the state fee.
  10. Inventory of the package of documents. Here you need to specify in detail what exactly you are submitting for consideration.
  11. Departure list (when contacting consular departments outside the republic).
  12. A copy of the guarantee of granting citizenship of another country or a certificate of acceptance, translated into Russian, in two copies.
  13. Binders - 2 pcs.

Recall that before contacting the department, you should clarify what documents need to be prepared. They will tell you how to fill out the waiver of Uzbek citizenship if difficulties arise.

If an application is submitted immediately for an adult and for a child, the permission of the second adult (if he is a citizen of Uzbekistan) should be attached to the package of documents. When applying by both parents and children aged 14-18, the latter will need to write their consent to renounce citizenship.

Make sure that copies of papers are made on A4 sheets and in good quality.

Fee and terms of consideration

The resolution of the issue of granting the application may take a rather long period of time. According to the norms prescribed in Uzbek law, this can take at least a year. Practice shows that this deadline is not always observed. Some have to wait up to two years or more for a response, and there is no guarantee that it will be positive.

How much money is needed to carry out the procedure will depend on the place of application. The consular section will have to pay a fee of $ 120. Children under 16 years of age are exempt from payment.

If you submit a petition on the territory of the republic, the amount of the fee will be equal to two minimum wages established in the state at the time of application (now it is 202,730 soums or 3,198 rubles).

Additional costs will be required for copies of documents and their notarization.

If a refusal is received, the duty is non-refundable.

Certificate of lack of Uzbek citizenship

After signing the decree by the President, the applicant must surrender the passport of his former homeland at the consulate and receive a certificate of lack of Uzbek citizenship. This document is most often required in the process of applying for work in public service bodies or at enterprises with a high level of secrecy. It is demanded even from those who have been living in Russia since childhood, but whose place of birth is indicated in the passport as “Uzbekistan”.

The certificate of withdrawal from the resident status is issued by the Office of OVViOG under the Ministry of Internal Affairs of the country at the address of the former residence permit of the migrant. If it is not possible to leave for the former homeland, a certificate of non-citizenship of Uzbekistan is requested from the Uzbek consulate in the country of the new residence. To do this, you need to fill out a questionnaire, attach 2 photos to it, a receipt for payment of the fee. The wait will take about 6 months.

For what reasons can you get a refusal?

The consideration of the request does not always end with a positive outcome. Some applicants are denied due to:

  • unpaid bills, loans, fines or alimony;
  • the presence of a criminal record;
  • identification of the fact of forgery;
  • a threat to the security of the state or its citizens in the event of the applicant's loss of an indigenous

If it is not possible to consider the application, the applicant is issued a certificate of the impossibility of renouncing the citizenship of Uzbekistan. It should indicate that nothing depends on the applicant himself.

To obtain a passport of another country, a migrant will have to apply to renounce Uzbek citizenship. This can be done both on the territory of the republic and at the place of new residence.
