Every foreigner intending to live in Russia for a long time is required to issue an appropriate permit - RVP. Also, obtaining this permission is a prerequisite for granting a foreigner (whether a citizen of another state or stateless person) the status of an official resident, and subsequently a full citizen of the Russian Federation.

RVP - what is it and what it looks like

Explanation of the abbreviation "RVP" - temporary residence permit.

The permit has the form (based on the international status of the holder):

  • A stamp in a passport, or a document similar from a legal point of view (for full citizens of other states);
  • An independent document of the established form (for stateless persons and citizens who do not have an identity card for objective reasons).

From a legal point of view, both aforementioned permission options are absolutely equivalent and contain the same information:

  • Full name, gender, current citizenship of the holder;
  • Start and end dates of the permit;
  • The name of the issuing government agency.

Legal consequences of owning

Starting from the receipt (and throughout the entire validity) of the permission in question, the owner has the right to:

  • Live (as well as issue permanent registration at the place of residence) in the Russian Federation;
  • Cross the borders of the Russian Federation an unlimited number of times;
  • Receive assistance in public health care facilities free of charge;
  • Officially find a job without the need to obtain the appropriate permits;
  • Conduct entrepreneurial activity (upon obtaining the status of an individual entrepreneur);
  • Send a request for a residence permit, or entry into Russian citizenship (if other legal requirements are met).

At the same time, the holder of the aforementioned permission undertakes:

  1. Live and work without leaving the region in which it (permit) was issued;
  2. Do not spend more than 6 consecutive months outside of Russia.

Failure to comply with these restrictions is a reason for canceling the TRP.

Quota mode

According to legislative requirements, permits related to this category are issued by authorized government agencies strictly within the quotas set for each region individually - depending on the demographic and economic situation, as well as other factors.

Upon the exhaustion of the indicated quota, the issuance of permits for the region is suspended until the end of this year. However, the legislation also provides for a non-quota option for issuing.

The main conditions for an applicant to fall under the regional quota:

  • Submission of the relevant request to the authorized state body until its (quota) is exhausted;
  • Knowledge of the state language at the established level;
  • Absence of dangerous diseases (in particular, HIV infection) and / or drug addiction.

The unquote issuance procedure applies to applicants who meet at least one of the following requirements:

  • Born in the Russian Federation;
  • Born in the RSFSR and possessing Soviet citizenship;
  • Fulfilling contractual obligations in service in the Armed Forces of the Russian Federation;
  • Have at least one incapacitated next of kin-Russian (parent or child);
  • Being in a valid marriage with a Russian (the Russian spouse is obliged to have a permanent registration and live in the Russian Federation);
  • Making investments in the economy of the Russian Federation;
  • Participating in the state resettlement program;
  • Those who are incapacitated and have a capable next of kin (parent or child) holding Russian citizenship;
  • Minors and / or disabled, and living with a parent (guardian) who already has or is applying for a permit in a non-quota order based on at least one of the above reasons.

However, even if there are such grounds, the documents are submitted by the applicant (or his official representative) within the framework of the general procedure. The procedure (quota or non-quota) for issuing a TRP is determined by the authorized state body individually for each applicant.

Registration procedure

Regardless of the quota regime applicable to the applicant, the receipt of a TRP is preceded by:

  1. Passing a compulsory medical examination;
  2. Passing testing for the possibility of socio-cultural integration (exam for language proficiency and knowledge of the basics of culture and legislation);
  3. Preparation of documents, payment of state fees;
  4. Submitting a request.

The aforementioned request is sent to the department of the Ministry of Internal Affairs that carries out migration regulation at the applicant's place of residence.

Feeding options:

  1. In person (through the local authorized subdivision of the Ministry of Internal Affairs, or the diplomatic mission of the Russian Federation operating in the territory of the applicant's actual residence country);
  2. Remotely (via the State Service website).

In the latter case, all required documents are sent in the form of digital copies.

Regardless of the method of submitting the request, during the next (after the day of submission) working day, the applicant is notified of the possibility (or impossibility) of issuing the permit in question. The applicant is also informed about the place and time of the actual issue of the permit, or documentary confirmation of the refusal.

Preparation of documents

To submit the request in question, the applicant needs to prepare:

  • Corresponding application (2 copies);
  • A copy of your passport;
  • Certificates confirming the absence of a criminal record and registration with the migration control authorities;
  • Photos (2 or 5 pieces - for real citizens and stateless persons, respectively);
  • Documentary evidence of the passage of the above-mentioned medical examination and testing;
  • Confirmation of the grounds for obtaining a TRP in a non-quota order (if any): a certificate of birth, incapacity, marriage, participation in the aforementioned state program, etc.

All foreign documents must be completed with notarized translations. In case of refusal to accept the application, all documents are returned to the applicant. At the same time, he is also informed of the terms and conditions for resubmitting the request.

Cost, terms

The size of the state duty - 1.6 thousand rubles As required by law, the fee is payable prior to obtaining a permit. That. the applicant has the right to pay it after submitting the request and receiving confirmation of the possibility of issuing a permit.

The deadline for issuing a RVP requested in the Russian Federation is limited to 6 months from the date of acceptance of documents by the Ministry of Internal Affairs (regardless of the quota regime).

This period is reduced to 2 months (60 days) if:

  1. The documents were submitted abroad, and the applicant actually participates in the above-mentioned state program;
  2. The applicant entered the Russian Federation in a visa-free regime.

Possibility of failure

Authorized state bodies will refuse to issue a TRP if the foreigner:

  • He is not entitled to enter the Russian Federation on the basis of a decision made in relation to him by the state authorities of the Russian Federation;
  • Provided knowingly false or fake information or documents (or the submitted documents do not meet other established requirements);
  • Does not have a permanent place of residence after 3 years have passed since the moment of entry into the territory of the Russian Federation;
  • Submitted a second application earlier than 12 months after the receipt of the refusal to issue a TRP;
  • Has not paid the state fee, suffers from drug addiction and / or is sick with a dangerous disease (or there is no evidence to the contrary);
  • By his actions, he directly or indirectly threatens the security of the Russian state or people (incl.through terrorist or extremist activities);
  • Deported from the Russian Federation within 5 (once) or 10 (repeatedly) years preceding the day the request was submitted;
  • Has an outstanding conviction for acts qualified by the court as grave, especially grave, or related to the circulation of prohibited substances;
  • At least 2 times in 1 year, he was prosecuted under articles of the Code of Administrative Offenses of the Russian Federation for violations of public order, labor or migration legislation, or for acts related to the circulation of prohibited substances.

In view of the strictness of the established requirements, it is possible to avoid the refusal to grant the permission in question only by strictly following the legislative norms in force in the Russian Federation, as well as by strictly observing other requirements that apply to the registration procedure.

The function of the considered category of permits is to give foreigners (regardless of their international status) the right to stay and carry out legal activities in the Russian Federation. Before the expiration of the temporary residence permit, a foreigner must find permanent housing, officially find a job, and also take measures regarding his further naturalization, or leave the Russian Federation.
