In 2019, amendments were made to the text of the main normative legal act, since 2002, regulating the rules and procedure for issuing a temporary residence permit (RVP) in the Russian Federation to foreign nationals - Federal Law No. 115. In the same year, an order of the Ministry of Internal Affairs came into force, strictly regulating the application forms, the form of the stamp and other nuances of the procedure for issuing this document.

What law regulates the receipt of a temporary residence permit in the Russian Federation

A permit is a mark in a passport or a separate document granting the right to a foreigner to live and work on the territory of the Russian state for three years after registration. The specifics of obtaining are governed by federal regulations.

The regulatory status of the RWP and the general provisions for its receipt are enshrined in the Federal Law of 25.07.2002 No. 115-FZ. This is not a new RVP law in Russia in 2021, but an edition adjusted to take into account modern realities.

How to get a temporary residence permit in the Russian Federation

The algorithm for obtaining permission consists of the following stages:

  1. Determination of eligibility for a quota or beyond this amount;
  2. Selection of the nearest department of the Main Directorate of Internal Affairs of the Ministry of Internal Affairs of the Russian Federation;
  3. Submission of application and documents;
  4. Waiting for the end of routine procedures;
  5. Passage of fingerprinting;
  6. Obtaining a RVP.

A quota is a ceiling on the number of permits issued to foreign nationals in the current calendar year. This limit is approved annually by the Government of the Russian Federation, taking into account the socio-demographic and economic situation in a particular region.

So, in 2021, almost 84 thousand permits are to be made throughout Russia, while the five leaders in terms of quotas included:

  • Moscow region (without Moscow) - 4000;
  • Samara Region - 3800;
  • Krasnodar region - 3500;
  • Rostov region - 3500;
  • Saratov region - 3500.

Regardless of the existing quotas, the preferential right (provided that the procedure is followed and there are no compelling reasons for refusal) to receive a TRP have:

  • Foreign nationals whose place of birth is indicated on the territory of the RSFSR or the Russian Federation;
  • Children, spouses and parents of a Russian;
  • Investors;
  • Military under contract;
  • Participants in the resettlement program for compatriots from Armenia and other CIS countries.

Submission of application and documents

To obtain a permit, a migrant must contact the territorial department of the Main Directorate of Internal Affairs of the Ministry of Internal Affairs of the Russian Federation, filling out an application form in the form and attaching the following documents:

  • 2 photographs 3.5x4.5 cm;
  • National passport;
  • Residence permit from the country of permanent residence, if there is a difference between the country of residence and the country that issued the passport;
  • Certificate of no criminal record;

There is no need to come for the decision itself - the department gives the answer by mail, and with it it is already necessary to stand in line for fingerprinting and get a mark in the passport.

The main reasons for refusal or cancellation include:

  • Submission of forged documents;
  • Committing serious criminal offenses;
  • Departure outside the Russian Federation for a period of more than six months;
  • Deprivation of parental rights, if the documents were submitted in relation to the child.

Passing fingerprinting

Fingerprinting - taking fingerprints - from an applicant for a RVP is a mandatory step in order to obtain the coveted mark. The procedure is carried out on the day of contact in an authorized department of the Main Directorate of Internal Affairs of the Ministry of Internal Affairs. Confirmation is a certificate issued by a specialist with a signature, seal and registration number.

Obtaining a temporary residence permit

The very procedure for obtaining, in the presence of citizenship of their country, is the affixing of a stamp in the foreigner's passport. Then you can:

  • Get a job without obtaining additional permits;
  • Live within the territory of the subject of the Russian Federation that issued the permit;
  • Do business;
  • Receive medical care on a par with Russians;
  • Apply for visas and travel to other countries.

The procedure for obtaining a RWP has not undergone major changes in 2020, and cardinal revisions are not expected in the coming calendar period. The regulations governing this procedure are regularly adjusted taking into account modern requirements, changes in the foreign policy situation, etc. The issue of issuing a permit still belongs to the functionality of the Main Directorate of Internal Affairs of the Ministry of Internal Affairs of the Russian Federation.
