Features of registration after receiving a TRP

Every foreigner intending to live in the Russian Federation for a long time must obtain a temporary residence permit. At the same time, after receiving the TRP, the migrant must also perform a number of related procedures, the first of which is registration at the place of residence.

Registration required

According to paragraph 2 of Art. 7 of Federal Law No. 109-FZ, each holder of a temporary residence permit is subject to registration at the place of residence (or temporary stay). Until 01.10.1993, this action was denoted by the concept of "registration", but now it is incorrect to use this term.

The obligation to register applies to all categories of foreign citizens (and stateless persons) temporarily residing in the Russian Federation without exception. Ignoring this requirement is fraught with serious legal consequences for the migrant.

Registration options and conditions

Registration by RVP is possible at:

  • Own housing, whether it be a separate room, or a whole apartment or house (condition: availability of a certificate of registration of ownership of the indicated real estate);
  • A living quarters belonging to a relative (condition: a valid contract of gratuitous use and documentary evidence of the relationship between the owner of the home and the migrant);
  • Rented housing (condition: the presence of a valid contract of civil tenancy or gratuitous use and the corresponding written permission from all property owners);
  • Municipal housing (condition: the existence of a valid contract for the sublease of an object related to the state or municipal housing stock, and the written consent of the head of the housing department of the administration of the settlement within which this housing is located).

Procedure

To register you need:

  1. Prepare the necessary documents;
  2. Draw up a relevant application;
  3. Pay a state fee;
  4. Submit a petition, complete with collected documents, to the authorized government agency.

Required documents

According to Art. 17 of the aforementioned law, in order to submit a request, the registered person (or his legal representative) must prepare a corresponding statement, as well as (both originals and copies):

  • National passport, or another document similar from a legal point of view and its notarized translation (the requirement does not apply to stateless persons);
  • Directly RVP (stamp in the passport, or an independent document - depending on the international status of the migrant);
  • Documentary evidence: the existence of rights to operate housing (see the above conditions for each of the options on the list) and the fact of payment of the state duty.

It is not always necessary to have documents for housing. The applicant may not submit them if the information contained in them is already at the disposal of the state or municipal departments of the Russian Federation.

Filling out an application

The main part of the document indicates:

  • The name of the department of the Ministry of Internal Affairs that carries out migration control at the place of issuance of the TRP;
  • Information about the applicant (name, date of birth, valid citizenship, postal address of the place of residence in the Russian Federation, passport data);
  • Grounds for settling (full name of the owner of the property, details of the contract, etc.);
  • RVP details (number, when and by whom issued, validity period);
  • Registration address at the last place of residence in the Russian Federation;
  • Date of filing and signature of the applicant.

In the detachable part of the form, a request is made to remove the applicant from the register at the last (at the time of filing the request) place of residence. All information is entered by analogy with the main part.

On the reverse side of the document, information about (if necessary) is entered:

  • Legal representative (if the registered person has not reached the age of 18) - name, gender, passport data, date and place of birth;
  • The applicant's ownership of other residential property located within the territory of the Russian Federation.

Other rules for filling out an application:

  1. A separate copy is drawn up for each registered person;
  2. The document can be filled in manually, or on a computer (and then printed);
  3. Factual errors and / or corrections are unacceptable.

Submission and terms of consideration

All prepared documents are sent by the applicant to the department of the Ministry of Internal Affairs that carries out migration control at the place of issue of the TRP. Documents can be submitted both directly to the Ministry of Internal Affairs and through the local MFC. Maximum allowable request submission period - 7 dayscalculated from the date of issuance of a TRP to a migrant.

Moreover, according to Art. 18 of the above law, registration is carried out:

  • On the day of submission of the request - if the applicant has submitted all documents from the above list;
  • During the working day following the day of submission of the request - if information confirming the rights to housing is requested by employees of the Ministry of Internal Affairs from other government agencies.

Price

According to the provisions of the Tax Code of the Russian Federation (in particular, clause 19, part 1 of article 333.28), the procedure in question is subject to state duty in the amount of 350 rubles. (for each applicant). At the same time, migrants (and members of their families) who are participants in the state program for the resettlement of compatriots in the Russian Federation are exempted from the need to pay this fee (clause 6 of article 333.29 of the Tax Code).

Possibility of failure

Registration will be denied if:

  • The migrant has already been registered under the RVP in another region of the Russian Federation and has no legal basis for moving;
  • There are no required documents for no objective reason;
  • The submitted documents do not meet the established requirements;
  • The state duty has not been paid, or there is no evidence to the contrary;
  • The submitted application was filled in incorrectly.

Refusal can be avoided only by observing the requirements imposed by the legislation for the procedure in question. In case of refusal, the employees of the Ministry of Internal Affairs responsible for receiving such requests are obliged to give the applicant comprehensive explanations about the nature of the violations committed, as well as recommendations for their prompt correction.

Registered persons rights

After registration, the migrant receives the rights:

  • During the validity period of the permit to live in the premises at which he is registered;
  • Officially apply for a job (within the region where he is registered);
  • Obtain a compulsory medical insurance policy and receive free assistance in state medical institutions;
  • Register your own newborn child without the consent of the owner of the home;
  • Register your own children in educational institutions (kindergarten and / or school) at the place of residence.

Actions when you change your place of residence

According to the migration legislation, holders of a temporary residence permit have the right to change the region of their residence (and to carry out other legal activities) only under the following conditions:

  • Ownership at least 2 properties residential real estate located in different constituent entities of the Russian Federation;
  • Participation in the above-mentioned state program;
  • Residence of close relatives in other regions of the Russian Federation.

Thus, if there are such grounds, the migrant can change the region of residence, for which it is necessary:

  1. Submit an appropriate request (and documents confirming the existence of reasons for moving) to the department of the Ministry of Internal Affairs that issued the TRP and registered the foreigner;
  2. Upon arrival at a new location no later than within 7 days (calculated from the date of the move) register again at the place of residence with the local authorized division of the Ministry of Internal Affairs.

Re-registration is almost the same as the above procedure.Exception - in the list of submitted documents, you must include the corresponding document-basis for moving to another region.

Penalties

Ignoring, as well as avoiding the fulfillment of the obligation in question is fraught with administrative responsibility for the migrant and entails the imposition of a fine in the amount of from 2 to 5 thousand / r, in some situations - with the subsequent expulsion from the Russian Federation.

In this case, the amount of the fine increases to the limit:

  • From 5 to 7 thousand / r - if such a violation has been committed repeatedly within 1 year, either on the territory of Moscow, St. Petersburg or adjacent regions;
  • From 7 to 10 thousand - with the simultaneous presence of both of these conditions.

The fictitious registration of a foreigner at the place of residence presupposes criminal prosecution and is punishable by:

  • A fine from 100 to 500 thousand rubles, or in the amount of the guilty person's income for three years;
  • Forced labor or imprisonment up to 3 years (in some cases - with a ban on the conduct of certain activities, or the occupation of certain positions for a similar period).

The subject of a crime is a person who intentionally took direct part in the implementation of a fictitious registration (for example, a home owner or an authorized official). In this case, the perpetrator is released from criminal liability if he contributed to the disclosure of his own crime, and if it does not contain corpus delicti of other criminally punishable acts.

The passage of the considered registration is the responsibility of each owner of the RVP. Ignoring the need and / or violating the procedure for implementing this procedure is fraught with administrative measures of restraint for the migrant, up to and including expulsion from the Russian Federation.
