A labor permit, officially called a work patent, is issued to foreigners who plan to work in Russia. It can be obtained by citizens of visa-free countries for Russia. This document is necessary for the realization of their right to work.
What is a working patent
A document according to which a foreigner who has entered a visa-free country and who wants to work in the Russian Federation is able to do so freely and legally.
With a patent, you can get a job in absolutely any field and with any business entity. Employment is allowed in the state of a legal entity and with an individual as a hired employee.
Who needs and who does not need
You will have to obtain a permit for foreigners from the following countries:
- Abkhazia;
- Ukraine;
- Moldova;
- Tajikistan;
- Azerbaijan;
- Uzbekistan;
Those arriving from the countries - members of the Customs Union do not need registration. It is not necessary for employees to receive it from:
- Armenia;
- Belarus;
- Kyrgyzstan;
- Kazakhstan.
Territory of action
This document fulfills the territorial limitation. A migrant can work legally only in the specified territory.
So, for example, it is impossible to work under a single patent both in the Moscow region and directly in the capital. For these two territories, there is a request for different patents - this is the rule introduced in 2016.
Important! But one foreigner can get two patents if needed. One - for employment within the city, the second - in the regional region.

Procedure for receiving
To start the process of obtaining, upon entering the Russian Federation, a foreigner must know and comply with the legislation that applies to migrants:
- Without a visa, he enters Russian territory and draws up a migration card;

- Insurance must be issued immediately after entry;
- Within a seven-day period after entry, you need to register with the migration register;
- After that, within thirty days, issue a work permit.

Medical examination
Consists of several stages:

Exam procedures
The state exam and the certificate of its completion are a mandatory procedure. It consists of three modules:
- Language of the Russian Federation;
- Russian history;
- The current legislation of the Russian Federation.
The examinee must be proficient in vocabulary and grammar, listening and speaking (speaking), reading and writing. These skills make up the language module.
The historical and legislative modules include 10 items each.
They will not be biased to check knowledge, but the language part must be passed correctly by 60%, and in the remaining sections, correctly answer 50% questions.
VHI policy
According to the law, any foreigner, including those who arrived at work, must buy a health insurance policy on the first day of arrival. It is drawn up by an insurance company. The sum insured must be at least 100,000 rubles. The coverage period is the entire period of stay in the territory of the federation.
For registration you will need a passport and a copy of the migration card.
Important! In the absence of this document, a fine from 5 to 7 thousand rubles is levied on the foreigner. If the violation is repeated, entry into Russian territory will be prohibited.
Statement
An application is filled out, the form of which can be obtained from the filing authorities, according to the sample. Information is entered in block letters. The language is only Russian. Errors and blots are not allowed.
Translation of documents
Before submission, all documents, how many are in the package, including the passport, are translated into Russian. Translations are certified. Photocopies of identity documents and migration card are made.
Fingerprinting
The procedure is not compulsory for foreigners, but those who apply for a labor patent are required to go through it. The prints are taken when all documents have been submitted for registration and the patent application has been approved at the territorial department of the Ministry of Internal Affairs. To pass you need to write an application for the procedure.
Cost and terms
A work permit can be issued for a period of one month to a year. 12 months is the maximum period. The first payment is made upon application. Payment of personal income tax for the month is being made. Then such payments should be made monthly, avoiding delays in the due date.
It is allowed to pay immediately for the entire period of the patent validity, but not more than 12 months.
The cost of a patent varies from region to region. Calculated by the formula:
- Base rate;
- Personal income tax ratio;
- Regional coefficient.
The base rate is uniform, for 2021 it is 1200 rubles... The coefficients are different by region. For a month in Moscow, a patent will cost 4500 rubles, for the Moscow region - 4300 rubles.
Important! In the event of a delay in payment, the patent is canceled the next day and becomes invalid.
A new patent after 12 months can be obtained without leaving Russia.
Authentication
This procedure may be necessary for both the employer and the owner of the patent himself in order to control its status and the accuracy of the data. You can check it yourself on the GUVM website services.fms.gov.ru.
But legally, this check is not valid. If you need an official conclusion, you will have to send a written request to the GUFM.

Liability for the absence of a patent
An employer does not have the right to conclude a contract for the employment of a foreign worker who does not have a patent, if he is legally entitled to it.
After obtaining a patent, the employee has a two-month period to find an employer. He sends a copy of the employment contract to the Main Department of the Ministry of Internal Affairs. If this is not done two months after receipt, the patent is canceled.
The employer also notifies the GUFM about the admission of a foreigner.
If the patent is expired, canceled, used geographically not where it was issued; if a migrant is working in another profession and otherwise violates the law, he falls under Article 18.10. Administrative Code.
According to the text of the article, a foreigner is liable to an administrative fine from 2000 to 7000 rubles... His expulsion from the Russian Federation is also possible.
By the way. The employer will also receive a fine if a foreigner works for him illegally. Here the amounts are higher. The official pays up to 70,000 rubles, and legal - up to 1,000,000.
It is forbidden for a foreigner to work without a patent in the Russian Federation if he arrived without a visa from outside the country of the Customs Union. Violation is punished severely. But if you comply with the law, renew the patent on time and work strictly within the framework of its validity, you can work in any area, for any business entity, under the same conditions as the citizens of Russia.
