The damaged passport is recognized as invalid and must be replaced with a new one. In this case, the circumstances of the damage are taken into account when choosing a penalty.

Replacing a damaged passport

The basis for changing the document in case of its unsuitability is the citizen's application. It is submitted to the police department or the migration service. The law prescribes cases of damage, as well as the obligation to take good care of the document.

Which is invalid

Replacing a damaged Russian passport is needed if it contains:

  • There are extra marks, notes or stamps;
  • The numbers and letters of basic records cannot be deciphered;
  • Seals, stamps and holograms are indistinct or worn out;
  • Information about a person is incorrect or inauthentic;
  • The document is expired;
  • The paper or cover is torn;
  • There are traces of exposure to fire, water and other liquids;
  • The passport is badly worn out.

The passport should not contain other seals and stamps, except for:

  • Marriage;
  • Military duty;
  • The presence of minor children;
  • Data on other passport documents;
  • Blood type and rhesus;
  • Registration data on the fifth page.

The basic information indicates:

  • Full Name;
  • Floor;
  • Date and place of birth;
  • Date and place of issue.

Other data are superfluous and will be a reason to call the document damaged. However, the lack of basic information is also a violation of the form of documentation.

At the age of 20 and 45, the passport must be exchanged for a new one, therefore, a discrepancy between the terms will be considered a violation and the document will also have to be changed.

To get a new document, you need to write a claim for damage. At the same time, the damaged Russian sample itself must be saved, it must be handed over to the FMS, there it will be entered into the database of invalid documents and destroyed.

The application is filled in according to the form that is received when visiting the institution. It is important to fill it in correctly. The application indicates:

  • Data on obtaining citizenship for a foreigner;
  • Signature.

You need to sign in the presence of an inspector who will certify this signature. Also in this application there is a second signature, which is put upon receipt of a new document. Separate columns in the application will be filled in by the inspector himself.

To speed up the process, you can submit your application and documents using the government services website or through the Multifunctional Center. It is better to submit documents in person, because it will be necessary to resolve the issue of measures of influence in connection with damage to the document.

If a person for health reasons is unable to contact these institutions, you can arrange for an employee to go home by submitting medical confirmation of a serious condition.

When contacting these institutions, an employee of the service will decide on the appointment of a fine for damage. A warning could also be an option.

If a fine is still received, then it must be paid before replacing it, for which details are given. This can be done through a bank or online wallets. The cost will depend on when asked to replace the damaged sample.

Also, in order to change the document, you will need to pay a state fee for the issuance of a new version. in the amount of 1,500 rubles. When submitting documents via the Internet, 30 percent discount, and the sum is 1050 rubles... In this case, you need to keep the receipt of payment.

After submitting the application, all other papers are submitted for obtaining a new passport. The service employee accepts them and issues a receipt and reports the time of issue of a new sample in the form of an appointment:

  1. The shortest period is 10 days, provided that the documents are drawn up at the institution at the place of registration;
  2. In other cases, the expectation increases. up to 30 days. For this time, you can issue a temporary certificate, for which you also write an application immediately upon filing and attach another photo.

If they refuse to receive a new passport, they will inform about this when accepting documents and explain the reason.

Required documents

When contacting the migration service for a passport exchange, you need to collect a number of documents. Their list is approved by law.

The following list must be submitted to the authorities:

  • Old, damaged and unusable document;
  • Birth certificate;
  • Documents on the state of marriage or divorce;
  • Documents for minors under 14 years old;
  • Receipt of payment of the fee for the new document;
  • A receipt for payment of the fine, if any;
  • Documents of attitude to military service (ticket, if any);
  • Information about registration at the place of residence;
  • New photographs, black and white or color, 3 by 4 centimeters - 3 pieces.

If you are planning to obtain a temporary ID, you need to take 4 photographs with you.

Administrative penalty

Each person is obliged to keep a passport carefully and not to damage it. Damage to the document is a violation of this provision and can occur both by preliminary design, which in legal language is listed as “intent”, and without it, that is, with negligence.

It is difficult to distinguish between these situations. Intention is punishable by article 19 of the Administrative Code and is determined by the employee of the service. At the same time, it is difficult to prove that there is a plan to spoil the document.

There is a presumption of innocence on the territory of the country, which means that a person has no guilt, unless proven otherwise. And under the Constitution there is no obligation to prove it. But we must prepare for the fact that they will try to impute an offense to the person and write out a fine, since a negligent attitude still appears in the law. It costs from 100 to 300 rubles depending on how quickly the application was submitted. You can appeal the fine by contacting the court or the prosecutor's office.

If it is decided to do without a fine, then a warning will be issued. Also extenuating circumstances are:

  • Natural disasters (fires, floods);
  • Road traffic accidents;
  • Injuries with significant damage.

60 days are given to pay the fine. For payment they give details. The procedure can be done through:

  • Cashier at the bank;
  • Terminal;
  • Online banking services;
  • Government services.

It should be borne in mind that the payment may take several days.

After payment, you need to take a receipt, which will be needed when drawing up a new document. If the fine is not paid on time, then a new penalty will follow, and the amount paid will be doubled. If no measures are taken to replace the passport and use a spoiled one, then at the first attempt to apply this document, a fine is imposed. The amount is on average 2000-3000 thousand. In Moscow or St. Petersburg, the amount increases to five thousand.

You can find out exactly how much the fine is in the region from the migration service or from lawyers. Until all the fines are paid, it will not be possible to fully use even a new passport, for example, to issue a foreign one and travel outside the country.

Refusal

In rare cases, this request may be refused. In this case, the reasons can be both justified and unreasonable.

Legal and competent include:

  1. Incorrect filling of the application for receipt;
  2. Lack of reason for replacement (damage was not confirmed, established age 20 and 45 years old did not come);
  3. Lack of a complete package of required papers;
  4. Violation of the rules of personal treatment;
  5. Availability of papers in a foreign language without a certified translation;
  6. Photos do not match the appearance;
  7. No old passport except for the loss and theft situation;
  8. There is no data on the identification and citizenship of the applicant;
  9. There is no information about the payment of the fee.

Most often, a refusal occurs due to errors in the application or an incomplete package. Separately, you can highlight the misunderstanding of the employee and the applicant, which is often the case for complaints in case of refusals. The first situation can be corrected immediately, and for a more complete set of necessary papers, another time is assigned to the service. Inappropriate reasons for refusal can be challenged in court or with the head of the service.

Replacement of a passport in case of damage takes place when contacting state responsible institutions with an application, an old passport and a package of other necessary papers. Often you have to pay an administrative fine; a state fee is mandatory.

A certain time is given to replace the damaged passport of the Russian Federation and to pay all expenses, after which administrative sanctions will also be imposed. Registration of the document may be refused, but the reasons for this must be justified.
