Temporary residence permit - a stamp in a foreign passport or other identity card of a foreigner, allowing you to stay in Russia for a certain period. You can submit an application and documents for a temporary residence permit at any branch of the Main Directorate of the Ministry of Internal Affairs of the country.

Normative acts and features of the RVP

All questions that a foreigner may have when receiving a TRP are stipulated in Federal Law No. 115.

The sixth article of the law fully describes:

  • Permit issuance regulations;
  • Terms and procedure for consideration by the migration authorities;
  • Possible validity periods and renewal issues;
  • Issuance quotas and ways to get a stamp outside the limit.

The next, seventh article of the law substantiates cases of refusal to issue a document, as well as options for resolving possible conflicts.

Important! Quota is an annual limit on the number of migrants who will be allowed to enter a specific region. Each region of the Russian Federation annually sets its own, unique restrictions.

The owner of the RVP in the Russian Federation has the following rights:

  • Free entry / exit to the territory of the country;
  • Employment without a patent or special permit;
  • The ability to register a company;
  • Eligibility for free health insurance.

At the same time, you can work only in the region in which the permit was obtained. For example, moving to Moscow with the Krasnodar Territory stamp is a serious violation of the visa regime and may lead to deportation.

On the part of the Ministry of Internal Affairs, the procedure for obtaining a stamp is described in Order No. 891. In addition to the regulations themselves, the order establishes the forms required for filing documents, as well as the appearance of the seal.

The difference between a package of documents with and without a quota

The standard list of documents for a temporary residence permit in 2021 looks like this:

  1. Standard statement established by order of the Ministry of Internal Affairs. The form can be downloaded here;
  2. Identity card - an ordinary or foreign passport with a period of at least 90 days;
  3. Visa or any other document confirming the legality of leaving the home country and entering Russia;
  4. Tests confirming the absence of HIV, tuberculosis, leprosy and syphilis in the applicant;
  5. Two passport-size photos.

For foreign citizens applying bypassing the quota, everything is somewhat more complicated. The table below describes the additional documents required for filing.

The main idea is that if a migrant has reason to bypass the quota, he must provide supporting papers. A complete list of categories of citizens and their corresponding documents can be obtained at any department of the GUFM of the Ministry of Internal Affairs.

Features of filling out and submitting an application

An application for a temporary residence permit is filled out in the migration department when submitting documents. The form can be obtained from an employee of the Main Department of the Ministry of Internal Affairs. The data is entered into the form by hand in block letters, in Russian.

In order to complete the application form, the applicant must provide the following information:

  • Personal data (full name, date of birth, passport details, religion and gender);
  • Current place of residence (address, telephone);
  • Level of education and additional vocational training;
  • Are there conditions for obtaining a TRP outside the quota;
  • Family composition, close relatives;
  • Source of income, information on labor activity, TIN (if any);
  • Convictions and extended information on them.

RVP is issued for 3 years without the possibility of extension. Further, the migrant either draws up a residence permit, or repeats the procedure from scratch. By signing the document, the migrant agrees to be held liable for giving false information. After the completed form with the package of documents is handed over to the FMS officer, the foreigner can only wait for the results of the check.

The general term for the provision of services is up to six months from the date of receipt of the application. Readiness is checked by the person who sent the application at the nearest branch of the Main Directorate of the Ministry of Internal Affairs.

Features for minors

For citizens of foreign countries under the age of eighteen, the form is filled out by parents or any other legal representatives. A sample form can be downloaded here. The same type of application is used for citizens with limited or no legal capacity.

Important! The list of documents of a teenager practically does not differ from that of an adult. Unless you have to confirm the rights of the guardian and provide two identity cards.

To fill out, you must indicate information about both the child and the legal representative. In the first half, you will need the following information:

  • Personal information (name, date and place of birth, gender, religion);
  • Information about current citizenship and nationality:
  • Passport data (or details of any other identity document);
  • Current place of residence;
  • Was there a criminal record, for what reason, and has it been canceled now.

On the other side of the document, the information about the parent (representative, guardian) who is submitting the application is filled in. You will need here:

  • Personal data of the guardian (full name, date and place of birth, gender);
  • Information about the temporary residence permit, residence permit or citizenship;
  • List of attached documents.

Possible problems when obtaining a TRP

In the application for registration of a temporary residence permit, a foreigner is informed that obtaining a permit is not guaranteed, and a refusal may follow with an explanation of the reasons.

Most often, applicants are refused for several reasons:

  • The application form is filled out incorrectly or with gross errors;
  • One or more required documents are missing;
  • The documents do not comply with the requirements of the legislation of the Russian Federation;
  • The quota for moving to this region has been exhausted;
  • Violation of the visa regime or refusal to pay state duty;
  • Providing obsolete or fake documents;
  • A foreigner with a simplified visa regime (Belarus, Kazakhstan, Armenia) did not provide a passport when registering at the entrance.

Other reasons are not grounds for refusal to consider. But the refusal to issue a TRP can be for almost any reason - from a typo in personal data to an outright ban from the state security authorities.

RVP is an intermediate link between a simple visa and a residence permit. A foreigner with a permit has the right to live and work in the region of his choice for several years in order to make a final decision after the expiration of the term.

In most cases, the stamp is provided without any problems, closing the issue of living and working in the Russian Federation for 36 months. When registering, you should remember about the "temporary" nature of the permit - it will not be possible to extend it.
