After marriage, a woman has the opportunity to take her husband's surname. At the same time, she needs to replace the documents. In particular, it is necessary to change the passport, which requires contacting the appropriate authorities with a package of documents.

Change of passport due to marriage

A girl who is married, according to article 32, registered in the RF IC, has the right:

  • Do not change your surname, leaving it as it is;
  • Replace with the husband's surname (“exchange” in the opposite direction is also possible);
  • With the consent of both parties, it is possible to form a new surname by combining the surnames that the spouses wore before marriage
  • In the second and third cases, when the information changes, a passport replacement is required (in the third - including the spouse).

Replacement should be done in 30 calendar daysstarting from the day on which the registration was made. Otherwise, the newlyweds will be assigned a fine that will cost up to 3000 rubles in regions and up to 5000 in cities of federal significance, including Moscow and St. Petersburg.

If there is a valid reason, a fine can be avoided by providing, when submitting documents, a certificate of the existence of these reasons. However, in the absence of these, even with a slight delay in the state. the issuing authority has the discretion to fine or forgive latecomers.

At the same time, the authority carrying out the shift, in turn, is obliged to comply with the strictly established deadlines for issuing, depending on where the registration is carried out:

  • If an application for a replacement is submitted to the FMS at the place of residence, i.e., permanent registration, the change will be required to carry out in 10 days;
  • If the application is submitted not to the authority at the place of registration, but at the place of stay or temporary registration, the period is extended to 30 days. In the event of a delay, the applicant must be notified of the reason for it and a new deadline.

Replacement procedure

Changing a passport after marriage does not differ from that due to a change in appearance or reaching twenty and forty-five years. To complete the procedure, you need to personally visit the relevant department of the Ministry of Internal Affairs of the Ministry of Internal Affairs (Federal Migration Service, also known as the “passport office”) and send an application for change, completed in accordance with a standard form, attaching a package of necessary documents to it. This can be done both at the place of registration and at the place of stay.

You can apply in other ways:

  • Through the MFC branch. The procedure does not differ from filing an application through the FMS, but if it is carried out not at the place of permanent registration, the period may increase slightly. The MFC does not deliver to the passport office immediately after receipt, so the delay can be two to three days. In this case, no penalty is imposed, since the time is counted from the moment the questionnaire is submitted;
  • Through the portal "Gosuslugi"by filling out the form in electronic form and indicating the required date. After sending it, it will be accepted for processing by the appropriate department of the Main Directorate of the Ministry of Internal Affairs. At the same time, on the day of the collection, it is important not to forget the originals and copies of all papers necessary for issuing.

  • When the applicant submits an application for a place of residence or permanent registration, the time limit for issue goes out in 10 calendar days;

State duty

State size the fees for replacing the identity card due to marriage do not differ from the usual and is 300 rubles... When submitting an application, the rest of the papers must be accompanied by a receipt confirming the payment of the state duty.

If the procedure is drawn up through "Gosuslugi", then the required amount can be paid remotely. Also, a receipt can be issued through the official website of the Ministry of Internal Affairs of the Russian Federation.

Required documents

A package of documents must be attached to the application for a replacement:

  • Standard application form number 1P. The form can be completed on a computer or manually. When filling out, the surname should be valid, that is, accepted after marriage. The form itself can be downloaded from the website of the State Services or the Ministry of Internal Affairs, and can also be seen at the stand in the passport office. In the absence of it, it should be requested from the responsible employee;

  • Previous passport of a citizen of the Russian Federation, containing the necessary mark about the concluded marriage;
  • Birth certificate. In the absence of this, the applicant has the right to receive a second one at the registry office at the place of permanent registration. Also, in the registry office, you can request a change in the data in the certificate itself. Despite the fact that this item is optional, the need for presentation depends on the specific department of the FMS. If the presentation is not possible, the applicant must provide other papers confirming the required information;

  • Two photographs, b / w or in color, 35 × 45 mm in size. The format of the photographs is standard - the citizen must be shown in full face. Items of clothing that cover the face and interfere with identification, including hats, are prohibited. The oval of the citizen's face, according to paragraph 38 of the AR of the Ministry of Internal Affairs, must be at least 70% and not more than 80% of the vertical size of the image;
  • A certificate confirming the conclusion of marriage, with the entered information about the old and new personal data. This certificate is withdrawn upon filing an application and returned within the prescribed period. You also need to attach a photocopy of this paper;

  • A receipt confirming the payment of the state fee. The size is 300 rubles. The details of the FMS department can be found on the "Gosuslugi" portal or check with a representative of the department.

This is not a complete list. A citizen may also need additional papers:

  • Persons liable for military service (for example, women who studied at a medical school or contracted employees) must provide a military ID;
  • If there are minor children under the age of fourteen, it is possible (but not required) to provide their birth certificates;
  • If there were no registration marks in the previous passport, i.e. registration at the place of residence, documents proving its existence should be submitted.

If necessary, in unique cases, the passport office will ask for certificates not included in this list. This is usually required if the applicant does not have citizenship.

Penalties

For late filing of an application, a fine is prescribed, prescribed by the AK of the Russian Federation in Article 19.15. A citizen who does not send an application to the passport office or other institution thirty days before the date of marriage will be fined.

In the regions, the amount of the fine is up to 3000 rubles inclusive, in cities with federal status - up to 5000 rubles inclusive. The amount is not fixed, but does not exceed the indicated one. If a citizen has a valid reason for delay, he will have to provide evidence.

If the delay was insignificant, the corresponding state. the body has the right not to charge a fine depending on how many days it was. But he is not charged with this, and it all depends on the specific instance.

Temporary identity card

For the time it takes the state. authority, in order to change the identity card, the applicant has the right to request a temporary identity card.

For its registration you will need:

  • Two 35 x 45 mm photographs that meet the above requirements;
  • A written request in any form for the provision of a temporary certificate.

The form of such paper has not been officially established, so its appearance depends on the wishes of the issuer.Usually, such a certificate is valid for the time required for replacement, or, in case of delays, 30 calendar days... When issuing an updated identity certificate, it is withdrawn in any case, regardless of the prescribed duration.

It is impossible to issue this paper at the MFC, but the FMS branch has no right to refuse to issue it. An applicant who has been refused has the right to file a complaint.

Having changed her surname after marriage, a citizen needs to quickly change the main document (within 30 days) to avoid a fine. Changing others can wait. However, it will also be required sooner or later, and for this a new passport will be needed. At the same time, if the newlywed decides to leave her own maiden name, running around in instances can be avoided.
